Fed: Gutnick delighted with High Court decision
Mining magnate JOSEPH GUTNICK says he's delighted he's taken on the media and won inAustralia's highest court.
In a unanimous decision that could have worldwide implications for internet publishers,the High Court has dismissed a bid by international news service Dow Jones to have a defamationcase brought by Mr GUTNICK heard in the United States.
Mr GUTNICK claims he was defamed in an article on a website hosted by the Wall StreetJournal in New York.
He wants the case heard in Melbourne, the city where he claims his reputation was damaged.
Dow Jones, which operates the website, wanted the case heard in the US because it saysthat's where the article originated.
The High Court has ruled that a defamation action can be brought wherever the informationis viewed.
Mr GUTNICK has told the Nine Network the decision means media organisations will haveto be very careful about what they put on the internet.
He'll now pursue his action in the Victorian Supreme Court.
